The following represents the current user agreement for users of Webpages of Charleston, ASP (Application Service Provider). This agreement may be updated periodically. In this User Agreement ("Agreement"), "WPC", "We" and "Us" mean Webpages of Charleston. "you" means the person or entity registered to receive Internet Services through WPC's Website and/or Websites.

We Protect Your Right to Privacy

Webpages of Charleston is vigilant about protecting your privacy. As a computer security company, we understand the need for you to maintain control over your personal data when using the Internet. We maintain our privacy through enforcement of strict internal policies.

Privacy Statement

This statement discloses the privacy practices for Webpages of Charleston. We have designed Webpages of Charleston so that no personal identifying information is displayed online or is accessible to the general public. We have appropriate electronic and physical security measures in place with our computer systems and physical facilities to protect against theft, loss, misuse, or alteration of any profile information that has been supplied. We use government grade encryption on the database, browser. (as well as other communication technologies when necessary)

Visitor Information

There is a limited amount of information that a site can gather about its visitors without the visitor explicitly providing information, such as completing a form. Webpages of Charleston does set cookies. Aggregate information may include demographic data, domain names and site traffic as long as none of these fields are linked to personal information. This analysis is used to improve our web site and refine our services. We consistently monitor our site for attempted attacks and will directly contact sites that have launched abnormal activity against our network or systems.

Sharing of Information

Visitor information is not sold or rented to other companies. We will not share, sell, or rent individual personal information with anyone without advance permission or unless ordered by a court of law. Information submitted to us is only available to employees managing this information for purposes of contacting you or sending you e-mail based upon your request for information. The only exception is when we are sponsoring a Webpages of Charleston Partner activity. In this case, we will clearly notify you of our intentions to forward your information on to our partner on the web form, and we will forward your information only to the participating partner. We do have relationships established with reputable ad server companies.

Your Account and Personal Information

You may voluntarily supply us with personal information, such as mailing address, phone number, email address, etc., by contacting us via email or by filling out a web-based form. We will occasionally use this information to contact you and provide notification of our services, new offerings, recommendations, timely information, or upcoming events. This may occur via email, phone, fax, or traditional snail mail. Depending upon how you contacted us, you may be able to opt-out with your first correspondence with us. In any case, you can opt-out at any time later by following the instructions in the "Opt-out Policy" paragraph.

Registration

you must be at least eighteen (18) years of age to register for the WPC Internet Service and you must use your own name when registering. By registering you agree to promptly defend, indemnify and hold WPC and its officers, employees and agents harmless from all claims, damages, losses, liabilities and expenses arising out of or in any way connected with use of the WPC Internet Service by you or others who use your password and account.


Passwords

You will receive a userid and password when you register for WPC Internet Service. Only one person using your password may be logged on to the WPC Internet Service at any time. WPC may terminate the session and/or your account in the event more than one person using your password logs on to the WPC Internet Service at one time. you are responsible for maintaining the confidentiality of the password for your account. you acknowledge that:

1. You are responsible for all activities that occur under your password or account

2. WPC is not and will not be liable for all loss or damage arising from any failure to maintain the confidentiality of your password. We do however encrypt through SSL and the Oncrypt system.

3. WPC is entitled to enforce an idle timeout. WPC prohibits the use of a any other computer system tool to avoid the timeout disconnection. WPC also reserves the right to enforce an 8 hour maximum limit for a single session use. If this occurs, you may immediately reconnect.

4. You agree that you will not profit, sell, or resell any service that WPC offers without written consent. This may include paid Internet Service to any other person, business, or other entity. You also agree you will not, and you will not permit others to, use your WPC Internet Service account to directly or indirectly:

1. transmit or receive any data that is unlawful, harmful, threatening, defamatory, pornographic (or which promotes pornography) or vulgar or that invades the privacy of others or that is otherwise objectionable
2. transmit or receive any data that contains a virus, trojan horse, cancelbot, time bomb, worm or any other harmful, malware, undesirable code, or program
3. attempt to gain unauthorized access to any computer system or network by any means
4. interfere with any other person's use and enjoyment of the Internet
5. attempt to intercept or view private communications not intended for you
6. violate any applicable laws or regulations
7. transmit unsolicited commercial email ("UCE") or unsolicited bulk email ("UBE") messages; or
8. for commercial use of WPC web space, unless special permission is given by WPC in writing.
9. use any of our products and/or services for an unlawful act.
10. you are responsible for spam. All spam can be accessed by the web mail system. It can be filtered by a spam filtering program.

WPC shall have the right to immediately terminate your account if WPC believes, in its sole discretion, you, or others using your account, are transmitting or otherwise participating directly or indirectly, in any SPAM or other unsolicited bulk email activity. In addition, you must agree to obey laws such as the Can Spam Act or pay WPC damages of 30% above all costs associated for SPAM or unsolicited bulk email transmitted from your WPC account.

5. CHARGES. All accounts (Free and Paid) are subject to price changes as upgrades and services are added. You are responsible for keeping all billing data which you have provided to us accurate and up to date. We may terminate your account if you provide us with false, inaccurate or obsolete data. If you fail to pay any charges when due, if a charge against your credit card is rejected or reversed or if your check is returned or otherwise not honored by your bank, We may terminate your account without notice to you. We may bill you an additional charge to reactivate your account. If you have signed up for one year of service and terminate your account during the first month, WPC will retain one standard months charges and refund to you the remainder of your payment. There are no other refunds. your credit card will be charged on the day you sign up, then every month thereafter on the same day. If you choose annual billing and pay by credit card, your credit card will be charged on the same day next year. Monthly and annual charges are billed automatically until you cancel your service.

Continuous service rates apply to credit/debit card payments and Electronic Fund Transfer payments. All amounts are billed in U.S. dollars at the beginning of each renewal period and will appear on your credit card statement as 'Paypal: Webpages of Charleston' and/or 'Charleston'. Your Webpages of Charleston subscription will be automatically extended for successive renewal periods of the same duration as the subscription term originally selected at the then-current non-promotional subscription rate. To change or resign your subscription at any time, go to Account Settings. If you resign, you'll enjoy subscription benefits until the end of your then-current subscription term; your subscription won't be renewed after that term expires. However, you won't be eligible for a prorated refund of any portion of the subscription fees paid for the then-current subscription period.

Newsletters

Newsletters are mailed only to individuals who opt into the newsletter service. Individuals who wish to receive the newsletter must subscribe to it by clicking on the link provided in the introductory email link sent to newly registered subscribers. Individuals who have subscribed can cancel their subscription by following instructions contained in each issue. Only an email address is required to receive the newsletter.

Surveys and Contests

Webpages of Charleston may from time to time sponsor surveys and contests. All information supplied is voluntary, and each survey form will contain an opt-out option. If you select to opt-out, your personal information will not be retained after completion of the survey project or contest.

Mandatory Binding Arbitration

EVERY CLAIM, CONTROVERSY, OR DISPUTE OF ANY KIND WHATSOEVER (EACH AN "ACTION") BETWEEN YOU AND WPC (INCLUDING ANY OF WPC'S EMPLOYEES, AGENTS, AND RELATED AFFILIATES) RELATING TO OR ARISING OUT OF OFFERING OR PROVISION OF INTERNET SERVICE, OR RESULTING FROM THE EXERCISE OF ANY RIGHTS CONTAINED HEREIN, SHALL BE RESOLVED BY FINAL AND BINDING ARBITRATION, REGARDLESS OF WHETHER THE ACTION SOUNDS IN TORT, CONTRACT, STATUTE OR ANY OTHER LEGAL OR EQUITABLE THEORY. TO ARBITRATE AN ACTION AGAINST WPC, YOU MUST INITIATE THE ARBITRATION IN ACCORDANCE WITH THE APPLICABLE RULES OF ARBITRATION OF THE AMERICAN ARBITRATION ASSOCIATION (WHICH ARE AVAILABLE ONLINE AT www.adr.org) OR By CALLING THE AMERICAN ARBITRATION ASSOCIATION AT 1-800-778-7879) AND PROVIDE WRITTEN NOTICE TO WPC BY CERTIFIED MAIL

Termination

You may cancel your account at any time if you notify us in advance. you agree that:

1. WPC, in its sole discretion, may terminate your password and account at any time, with or without notice to you
2. When your account is terminated or canceled, either by you or by us, without regard to the reason for the termination, WPC may remove and discard any data that you have stored on WPC servers, hard drives or other equipment or hardware
3. WPC shall not be liable to you or any third party for any termination or cancellation of your account or for removing or discarding data. If you have not breached any term of this Agreement and we cancel your account, we will refund to you a prorated portion of any charges you have paid for service after the cancellation date. To cancel your account, you must call us at 843.881.8584 with your account information. We can not accept notice of cancellation by email.

Disclaimer and Notification of Changes

1. ACCEPTANCE. Webpages of Charleston reserves the right to change and/or revise any of our website content (including this agreement/policy) at any time. You should periodically check the Agreement on the WPC web site http://www.CityofCharleston.info/legal/ for the most current version of this Agreement. Each time you use the WPC Internet Service will constitute renewed confirmation that you agree to the terms and conditions contained in the Agreement and your acceptance of all changes we make to the Agreement. We may revise this Agreement from time to time.

2. SUPPORT. If you experience problems with your WPC Internet Service you may go to the help section on the http://www.CityofCharleston.info/contact/ website. There you will find available a knowledge base program designed to answer the most commonly asked questions. If you are unable to resolve your issue, you may contact WPC via email at support@wpcharleston.com twenty-four hours a day, seven days per week. In addition to the free technical support options, WPC maintains a staff of customer service representatives who will be available to receive your calls 24/7. Whether you contact WPC by telephone or by email, we will use commercially reasonable efforts to respond to you within 24 hours. Charges for support will incur according to the WPC service package that you utilize.

3. DISCLAIMER OF WARRANTIES. EXCEPT WHERE PROHIBITED BY LAW, WPC MAKES NO EXPRESS OR IMPLIED WARRANTIES (INCLUDING WARRANTIES OF TITLE, NON INFRINGEMENT, AND IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE) AND DOES NOT WARRANT THAT THE INTERNET SERVICE PROVIDED By WPC WILL BE SECURE, UNINTERRUPTED OR ERROR-FREE OR THAT DEFECTS WILL BE CORRECTED. THE SERVICE IS PROVIDED ON AN "AS IS" BASIS. SOME STATES DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES. THEREFORE, SOME OF THE LIMITATIONS CONTAINED IN SECTION 2 MAY NOT APPLY TO YOU.

4. LIMITATION OF LIABILITY. YOU AGREE THAT WPC SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES RESULTING FROM:

1. THE USE OR THE INABILITY TO USE THE WPC INTERNET SERVICE
2. UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA (ie: you have a trojan horse on your computer, hacks, security vulnerabilities, etc.)
